Murder Solved From The Grave

I am very interested in reading about ghostly stories and spirits etc. A couple of years ago I heard about a story which is apparently true, about a murder which was solved from the grave.

This happened in the UK.

A woman in her twenties always believed she had special powers of being able to have contact with the spiritual world, however she did not want these powers and she certianly had never told anybody else about it. For the purpose of this article, I will call the lady Sue.

One evening about five miles away from where Sue lived, another young lady who I will call Lisa, was brutally murdered by somebody she had never met before.

Sue and Lisa had never met.

As you may be aware, the police find it harder to solve murder cases where the victim is unknown to their killer. These types of murder are also quite rare.

Later that evening Sue was awaken by a noise in her bedroom. As she sat up there was a woman on her bed sobbing, it was Lisa. Sue who was strangely quite calm asked her, who she was, why she was crying and why she was in her bedroom.

"I have just been murdered, I know you can help me"

Sue who was obviously shocked, asked how she could help her.

"I want to tell you what has happened to me and I want to describe the killer to you. I then want you to go to the police station tommorrow to tell them what I have told you. This will help them to find the killer, then I will be able to rest in peace."

Sue reluctantly agreed and Lisa disappeared.

Sue did go to the police and described the killer, telling them many things about him, including that he had a tattoo on his arm with the words "crazy fox" on.

The police did not take her as a serious witness, even though they found it strange that she seemed to know so much about the killing itself.

The murder itself went unsolved for twenty years, until a man was arrested for drunk driving. The police took his DNA and it was matched to the murder of Lisa.

Have a guess what he had tattoed on his arm, "crazy fox".

How To File Trademarks

Various companies, in strive to achieve higher market shares and widespread popularity tend to ignore the importance of trademark registration. Getting a trademark registration, though not a legal mandate, is as crucial as thinking of a name itself. The overall brand management and associated marketing efforts could go down the drain if the trademark is not registered. The registration of a trademark with the concerned authorities makes you the unique owner of a particular name or design and hence reduces possibilities of falsification or duplication in name.

Check Before You Invest: It is suggested to undertake an assiduous search before thinking or launching a brand name to affirm if somebody else has already registered the specific name. Registration Alternatives: The trademark can be registered either as a state or as federal trademark. The option to be selected from the stated depends upon the area of operation. In the case product is restricted to one state, the state trademark would be fine however, in the case the operations would be spread across at least two states, and federal trademark is considered appropriate.

Additionally trademarks can be filed in three situations i.e.: based on the use, based on a bonafide intention to use or for an application outside the country.

Registration Process: Depending upon the alternative selected, you can download the respective application as available online. The applications must be deposited along with the requisite registration fee and mentioned information:

The legal name of the applicant (often a corporate name);

The state of incorporation (for a corporation) or the country of citizenship (for an individual);

The exact form of the mark;

The use details

A description of goods or services with which the mark will be used; and

The international classification(s) for the goods and services

The applications are carefully scrutinized by the respective departments. A unique number indicating the acknowledgement is sent out to the applicant. This number is used in future correspondence. After about 4 months of filling, the applications are reviewed and corrections or objections are outlined which must be catered to by the applicant within 6 months. In case the objections are still not clarified, the application could be abandoned. However, in spite of the applicants clarifications, there are situations when the authorities are not satisfied and can reject the application. The applicant in such eventuality can appeal to Trademark Trial or Appeal board.

One can register a trademark all by one self however considering the implicit legal proceedings and requirements it is suggested to opt for professional help. There are firms or agents who deal in such related activities and have complete expertise of the procedures and anticipated issues.

Attention Real Estate Professionals, It's Time to Secure Your Email

If you have a wireless laptop, listen up! It's time to make sure your email is secure.

When you sit at your local coffee shop to surf the internet and get your email, you are most likely using a connection that is not encrypted. This means the data flying through the air from your laptop to the internet is not secure. It can be intercepted.

Most wireless hotspots don't bother turning encryption on because it would make them crazy having to hand out the password to everyone and then deal with all of the people that did not know how to use it to connect. To keep it easy for everyone, encryption stays off.

What this means is that when you send and receive your email, your username and password go flying through the air for any computer geek to grab. The tools you need to do it are so simple to use these days that even some non-geeks are getting in on the action.

It's a real risk to your security and the security of your real estate data that most people aren't aware of.

Fortunately, most email providers offer the option to encrypt your email transmissions (both sending and receiving) with the same level of security that you find when you log into your bank accounts on the internet. The tricky part is that you actually have to turn the option on for it to protect your email. And what's worse, some of the big name ISPs (like SBC) don't offer this option for subscribers.

If you have your own real estate website and corresponding email service, check with your web host as they probably DO offer the extra security.

This "extra security" is called SSL. It doesn't matter what it stands for, just know that it means that your email will be encrypted and therefore protected from prying eyes when you use the internet at wireless hotspots.

The quickest way to see if you "qualify" is to follow these simple steps:

1. Contact your ISP or web host and ask them if they support sending and receiving email with SSL encryption.

2. If they do, ask them for the correct settings to put into your email program.

As wireless hotspots become more and more widespread and the software that allows people to do wireless "snooping" becomes easier and easier to use, it is important that you take precautions to protect your data.

Understanding Non-Compete Agreements

When it comes to business law, there are a number of areas that make sense at first glance, but become complex when you get into the heart of the matter. Non-compete agreements are such an area.

Understanding Non-Compete Agreements

Every business has certain fundamental secrets that make it stand out over competitors. These secrets are usually held closely by the people running the business. They can include things such as business strategies, the key elements of a product, the development of future products, client lists and so on. Any business wants to protect this critical information, but employees have to be given access to it to work. The problem that arises with this situation is one or more of the employees will eventually leave the business and go work for a competitor. Do you think that competitor is interested in the business secrets? Oh, yes.

In an effort to protect business from this scenario, there is something known as a non-compete agreement. A non-compete agreement is pretty much what it sounds like. The agreement basically keeps one party from competing with another for a certain amount of time. In our example above, it keeps an employee with knowledge of your business secrets from heading off to a competitor and spilling the beans.

At first glance, a non-compete agreement sounds like a fairly simple document and strategy. It is not. Why? The problem lies in the restrictive nature of the agreement. While it makes sense businesses should be able to protect their secrets, what about the employee? Dont they have a right to work? Yes, they do. In fact, there is a legal axiom known by this very name.

So, who wins in this situation? The business or the employee? The answer depends almost entirely on what state you are in. There is no simple answer, so states tend to take positions all over the board on this issue. In some state, non-compete agreements are enforceable and can be used to protect business secrets. In other states, they are rarely worth the paper they are written on as the states heavily favor the employees right to work. Lets look at an example.

Microsoft and Google are two large competitors that are well-known for having a go at each other. Over the last few years, Google has been hiring former Microsoft executives. In some situation, they executives havent even quit Microsoft yet! This brings us to the case of Kai-Fu Lee, an executive at Microsoft who up and quit to work at Google. This gentleman had intimate knowledge of Microsofts plans for its internet efforts and other products, particularly as they applied to applications for the huge market in China. Google offered him a ton of money and allegedly even offered to pay his legal bills should Microsoft try to enforce a non-compete agreement Lee had signed. While Google has proven to be an extraordinary search engine, there legal efforts have left much to be desired. This case was no different.

Microsoft is located in Washington, while Google is in California. Washington favors businesses in legal matters and enforces non-compete agreements. California is right to work state and generally discounts non-compete agreements. Lee was working in Washington when he informed Microsoft he was quitting to work at Google. Microsoft sued in Washington and Google tried to fight it. Smartly, the non-compete agreement contained language wherein Lee agreed the place any dispute would be heard was the State of Washington. The case never made it to trial, but Google essentially lost. The settlement barred Lee from working on key products with Google for a year and one can guess that Google shelled out more than a minor amount of money to make the situation go away.

If you run a business, a non-compete agreement is potentially a tool you can use to protect yourself from employees who go to work for competitors. The exact answer, however, depends on the state you live in.

Mortgage Prepayment - Top Points to Ponder

When reality sinks in and mortgage holders realize how much interest they are paying on their home loan over the life of the loan, the knee jerk temptation may be to prepay the loan one way or another. Before you do make sure you think about these important points and weigh the alternatives carefully.

There are some pros and cons to repaying your mortgage early:

SAVE MONEY ON INTEREST Yes depending on the details of how long and how much you prepay you can save tens of thousands of dollars and reduce the term of the loan by years. On the face of it, it sounds great until you consider some of the following points.

TAX DEDUCTIONS For most people the interest is tax deductible so this needs to be part of the equation.

ALTERNATIVE OPPORTUNITIES If you had those dollars available to invest, for example, what could you achieve? Essentially if you can make more percentage wise on an investment than the cost of the mortgage which is relatively cheap it makes sense to invest rather than prepay.

PREPAYMENT PENALTIES Most loans don't have these any longer. Check to make sure before you make any prepayments. It could be a costly mistake.

RETIREMENT CONSIDERATIONS Be it a Keogh or 401k, if you are not maxing out a retirement plan and taking the tax break you may be making a big mistake. If you rather prepay your mortgage than maxing your retirement plan, you are making a mistake.

REFINANCING ALTERNATIVES Depending on your individual circumstance, refinancing to a better rate, shorter term, smaller amount, may achieve the same goal as prepayment. Do your homework. What are you trying to achieve?

LIQUIDITY Making a payment with a higher amount every month may put you in a cash poor situation. You should have a rainy day account with at least 6 months of salary/wages for emergencies.

Like everything else there are pros and cons of prepaying your mortgage. It is not as simple as it may first appear. Do your homework. If necessary, talk to a financial advisor, accountant, or attorney, someone who is not going to try to sell you something. Prepaying your mortgage is not all necessarily good.

Do You Know Where Your Kids Are?

Our family loves to travel. And ever since the kids were old enough to attend school, we looked forward to the spring break holiday with great anticipation.

The first few times we traveled on spring break, it made a real dent in our bank account. However, after a couple of years I learned how to plan ahead and avoid costly airline tickets and accommodations. We also learned to leave a few days ahead of the school schedule to avoid the rush hour and all of the hectic travel buzz.

Each year, the kids were so excited and anxious to get to our destination that the phrase are we there yet became forever embedded in my mind. As I look back at the fun we had with the four little munchkins, I cant fathom that they are now all grown up and that spring break no longer includes mom and dad.

In the mind of a teenager, the idea of a spring break is a simple one. Going away usually means, three things -- party, party and party some more. Unfortunately for my kids, my husband and I happened to vacation in Acapulco a few years prior to their becoming teenagers. What we witnessed there caused us to vow that we will never let our kids away from home during this time.

Picture the following scenario: a large number of girls -- aged 17, 18 and 19 -- laying across the top of the bar while the boys bought shots, poured them into the girls bellies and drank from there. Meanwhile, the bartender poured alcohol straight into the girls mouths. With an admission price of $20 that covers all you can drink within an hour, you can guess what happens. Most of the kids are obliviously drunk, and half of them are throwing up. Bouncers are located through out the club, but the situation constantly seems on the edge of losing control. The only positive to this horrific scene was knowing that the kids all arrived in taxis and would not be driving back to their hotels.

One advantage of being a young parent is that we are young enough to remember how we had fun. Plus, we can still walk in into a nightclub and at least observe from the back to see what we are up against. Of course we are also the biggest hypocrites, and what was good enough for us is out of the question for our kids. When my kids became teens and I started to freak out every time they would go out of the house, my art teacher gave me some sage advice. She said, You have to let them go and hope that the same God that watched over you will protect them. These words kept me going for few years, until Acapulco everything changed.

Fast forward a few years and we have become very unpopular parents who dont allow their kids to travel during spring break. Not surprisingly, weve had more than a few fights and disagreements with our children. You can imagine the resentment our daughter felt when we said that we can no longer stop her but we dont support her going in any way. Of course, she quickly brought up the fact that if she was a boy she would be allowed to go. We readily agreed that the double standard remains, and we pled guilty as charged. However, that doesnt mean we would support our son if he wanted to go.

My husband and I feel fortunate to have kids that actually value our opinion and usually listen to our advice, even if its done with much resentment. However, we can easily live with the resentment as long as they stay home. If you have kids that plan on going away this spring break, talk to them and ask them not to go. If bribery works, embrace it and go for it!

I admit to being a hypocrite on this subject, but the safety of my kids means everything to me. They can accuse me of being unfair and resent me for a while, but as long as they are next to me (or at least in a vicinity where I can convince myself that Im in control of the situation) I can sleep soundly at night.

When my eldest daughter turned 8 months old, I complained to my grandma that she never let me sleep. Grandma responded that infants dont let their parents sleep, and when they grow up, parents refuse to sleep and stay up worrying until they get home. That, my friends, is my reality at the moment.

MGM Mirage to build a city on Las Vegas Strip

Plans include a 4,000-room hotel and casino, three 400-room boutique hotels, 1,650 condominiums and 550,000 square feet of a retail, dining and entertainment area.

The "Project CityCenter" as MGM officials call it, will stand on the 66-acre site located between Belaggio and Monte Carlo, on Las Vegas Strip. The Boardwalk hotel now occupies part of this area.

The project will be developed in phases. The first phase, to begin in 2010, is expected to create over 7,000 construction jobs and 12,000 permanent positions. This will be the largest employment opportunity in the history of Las Vegas.

For comparison, "Project CityCenter" is the size of New York City's Rockefeller Center, SoHo, and Times Square combined.

The history of Las Vegas began a hundred years ago, with a land-parcel auction. With MGM Mirage laying down the cards for its future project, the next question to arise is: How long will it be before a competitor puts forward a similar scheme?

"We hope they do, but I doubt it," says Jim Murren, president and CFO of MGM Mirage. Having the idea is one thing. It is far more important to have access to this kind of capital outlay, and a suitable property. Today, an acre on Las Vegas Strip is valued at $20 million. The estimated cost of the project is $4 billion.

The "Project CityCenter" seems to have put an end to themed resort-building in Las Vegas, and to open a new era in the history of Sin City. It is now clear that Las Vegas is moving towards becoming a major urban center in the US. "It's changing lifestyles," MGM Mirage chairman and chief executive officer Terry Lanni said.

Over the next 18 months, MGM Mirage will look around the world for a master architect, as well as for residential and hotel partners.
